Litigation Holds
A litigation hold is a process to preserve documents/data that may be relevant to a litigation.
Due to recent federal and state laws and rules, there are defined obligations to preserve documents - both in paper and electronic format - that could be vital in the case of litigation. A 2007 memorandum by Douglas A. Bahr, Solicitor General, put out specific information on the background and implementation of litigation holds and the preservation of evidence.
