An area that is a potential trap for higher education administrators is the improper handlig of official personnel records. Specifically, supervisors need to understand the requirements of N.D.C.C. Section 54-06-21 covering public employee personnel records, filing of documents in those records, and access. In particular, in the past records relating to faculty have teneded to be much more diverse and spread out than records relating to classified employees, and this has caused some problems. Supervisors with hiring responsibility at NDSU must be aware of North Dakota's Veterans Preference Law. Lack of familiarity with the law may cause major hiring problems.
The law states that North Dakota resident veterans who meet the required qualifications for a position have an absolute preference right to be appointed to the position, uynless the agency has an "established personnel system." Disabled veterans are entitled to preference over non-disabled veterans. (In certain limited cases, spouses of deceased veterans can claim the preference right.) Read more...
