Enforcement

 Policy 153 is to be implemented and enforced similarly to all other campus policies.  However, since the policy is new, the following guidelines have been adopted to assist the NDSU community in understanding and enforcing the policy.  

Guidelines common to all NDSU community members (students and employees)

All community members (students and employees) are responsible for complying with Policy 153.  All community members are also responsible to remind/and or report non-compliant individuals.  Non-compliant individuals should be approached with respect and civility.  Non-compliant individuals should respond with respect and civility.

Individuals not complying with the policy may be reported using the Problem/Complaint Form going to the Dean of Student Life Office (Memorial Union, room 250).  For students and guests, forms should be submitted to the Dean of Student Life Office (MU250) and for faculty and staff non-compliance, forms should be submitted to Human Resources (Stop-n-Go Center).

Guidelines for employees

It is important for employees to act as role models for students and guests.  The main responsibility for enforcing all policies as well as Policy 153 rests with supervisors.  Supervisors should make clear that all employees are expected to comply with Policy 153.  Employees found in non-compliance may be reported using the Problem/Complaint Form.  Complaint forms received for non-compliant employees will be forwarded to the appropriate supervisors for action.  Supervisors should confront violations of the policy clearly and directly.  Failure to stop smoking after this request may be cause for disciplinary action.  Supervisors are encouraged to consult with Human Resources in addressing ongoing violations of policy.

Guidelines for students

Students are expected to comply with Policy 153.  Students found in non-compliance may be reported using the Problem/Complaint Form .  Complaint forms received by the Student Life Office will be forwarded to the appropriate offices (i.e. Student Rights and Responsibilities or Residence Life).  Student life may enter reports in to a database for tracking.

One "Problem/Complaint" form will result in a letter being sent to the student to remind them of the policy and encourage compliance, notify them that a report has been received, and describe the formal judicial process should a second report be received.

Two or more "Problem/Complaint" forms will result in a formal judicial hearing.

Guidelines for guests

Entities bringing visitors to campus should inform them of Policy 153 (link to policy).  The wording below may be used in brochures or other invitations for off campus guests.

In order to provide a clean and smoke free campus environment, all NDSU facilities are smoke free.  We appreciate your compliance with the policy.   

Problem/Complaint Forms received for non-compliance of guests will be referred to the guest host.  

Note: NDSU Police will only become involved in enforcement if a crime has been committed, or if safety or harassment become an issue.
