Guide to the Fair Labor Standards Act (FLSA)
The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, record keeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments.
The Wage and Hour Division (Wage-Hour) administers and enforces FLSA with respect to state and local government employment. The NDSU Office of Human Resources/Payroll can advise departments on how to administer FLSA correctly for their non-exempt staff.
As many of you are aware, our campus has been preparing for a significant change to the overtime rules of the Fair Labor Standards Act. These changes were to go into effect December 1, 2016. Hundreds of employees at NDSU were to be affected by the rule change.
On Tuesday, November 22, 2016, a U.S. District Court judge issued a preliminary injunction postponing the implementation of the new overtime rules. The Department of Labor is expected to appeal this ruling, and at this time it is uncertain how long the appeal may take. NDSU will postpone making any changes to personnel classifications until the rulemaking and revisions are finalized.
