An H-1B petition will be submitted for the below position(s).  This “Notice of Intent to Hire” is not a posting for an open position as candidates have already been selected to fill the position(s).

In compliance with the Department of Labor requirements for employers of H-1B and E-3 workers, NDSU must first file an electronic Labor Condition Application (LCA-Form ETA 9035E).  After the LCA has been filed, federal regulations require that the prospective employer of an H-1B or E-3 worker post this notice for 10 business days in a location where the non-immigrant worker will be employed.

Complaints alleging misrepresentation of material facts in the Labor Condition Application and/or failure to comply with the terms of the Labor Condition Application may be filed with any office of the Wage and Hour Division of the United States Department of Labor.  All Labor Condition Applications pertaining to these positions are available for public inspection at the NDSU Office of the Provost, located in Old Main, room 201.
